1. CATEGORIES OF MEMBERSHIP :
1.1 The categories of Membership of the Club shall be :
(a) Service Members
(b) Fleet Members
(c) Social Members
(d) Life Members
(e) Honorary Life Members
(f) Absentee Members
(g) Bridging Members
(h) Group Members
(i) Staff Members (including Regional Advisory Committee Members)
(j) Access Members
2. CRITERIA AND BENEFITS FOR MEMBERSHIP :
2.1 SERVICE MEMBERS :
(a) All Members shall be admitted as Service Members, except as hereinafter provided, upon payment of the set fee
(b) Subject to the By-Laws Service Members shall be entitled to the benefit of Roadside Advantage as referred to in the Service By-Laws.
(c) Service Members have the right to attend and vote at all General Meetings of Members and are eligible to be elected to any office of the Board in accordance with the requirements of the Constitution.
(d) Upon payment of an additional set fee (as set from time to time by the Board) a Service Member may upgrade the benefit of Roadside Advantage to the benefit of Roadside Ultimate as referred to in the Service By-Laws.
2.2 FLEET MEMBERS :
(a) Fleet Members shall be a firm, partnership, company or incorporated association and who, upon acceptance by the Club and payment of the set fees, shall be entitled to Service Membership privileges for at least two nominated vehicles unless there are special circumstances which in the opinion of the Club enable one vehicle to be nominated.
(b) Any firm, partnership or company comprising a Fleet Member shall be considered as one member only and any rights and obligations including voting rights shall be exercised by such Fleet Member as if it were a single person and not two or more persons or entities
(c) In the case of a firm, partnership or company being admitted as a Fleet Member, any rights and obligations including voting rights shall be exercised only by the person previously nominated in writing by the Fleet Member to the Club to do so. The individual so nominated has the right to attend and vote at all General Meetings of Members and is eligible to be elected to any office of the Club as set out in the Constitution.
2.3 SOCIAL MEMBERS :
(a) Upon payment of an additional fee (as set from time to time by the Board) a Service Member may become a Social Member.
(b) Social Members are entitled to reciprocal rights with other motoring clubs or organizations as may be negotiated by the Club from time to time and to any other benefit as the Club may decide from time to time.
2.4 LIFE MEMBERS :
Any Member may upon application to the Board and upon payment of such fee as the Board may from time to time determine, be elected as a Life Member of the Club and (notwithstanding any other provision of the Constitution and these By-Laws) such person shall thereafter be entitled for his life to all the privileges of a Service Member with the benefit of Roadside Ultimate without the payment of any future fee unless he shall resign or cease to be a member.
2.5 HONORARY LIFE MEMBERS :
(a) Any five Service Members may nominate any Service Member of at least 10 years standing for election as an Honorary Life Member.
(b) Every such nomination shall be in writing, shall state the grounds on which the nomination is made, shall be signed by the nominators and shall be forwarded to the Board at least eight weeks before the Annual General Meeting. Such proposed member shall be proposed for election for special services rendered to the Club.
(c) The Board, upon the receipt of a recommendation, may accept or reject the recommendation. Where the Board rejects a recommendation, the election of the Member as an Honorary Life Member will not be proposed at the Annual General Meeting.
(d) A Member must be elected as an Honorary Life Member by a special resolution passed at the Annual General Meeting.
(e) A member elected as an Honorary Life Member shall, notwithstanding any other provision in this Constitution, be entitled to all the privileges of a Service Member with the benefit of Roadside Ultimate as referred to in the Service By Laws without the payment of any further fee.
2.6 ABSENTEE MEMBERS :
(a) Any Member of the Club (who has paid his/her current year fees) intending to leave Tasmania may make written application to the Board to be placed upon the absentee list.
(b) A Member on the absentee list shall be required to pay only such annual holding fee as the Board may from time to time determine to maintain continuity of membership.
(c) If a Members absence shall exceed one year the ordinary subscription for the current year in which the Member seeks reinstatement as a Service Member must be paid before such Member is reinstated as a Service Member.
(d) An Absentee Member is not entitled to any of the privileges of a Service Member whilst he is on the absentee list.
(e) Members resident in other states of Australia, when returning to Tasmania, shall not be entitled to continue absentee membership.
2.7 BRIDGING MEMBERS (Non-Motoring) :
(a) A Bridging Member shall be a person or company who is entitled to access to a commercial roadside service plan and pays a fee as determined by the Board from time to time to maintain continuity of membership.
(b) A Bridging Member (unless also a current Service Member) shall not be entitled to attend and vote at General Meetings of Members nor to be elected to any office of the Club.
2.8 GROUP MEMBERSHIP :
(a) New Members and / or existing Service Members who have the benefit of Roadside Advantage can join together to form a group of Advantage Members
(b) New Members and / or existing Service Members who have the benefit of Roadside Ultimate can join together to form a group of Ultimate Members.
(c) A group will be issued with a combined fees account to a nominated addressee and that addressee will receive all communications from the Club.
(d) The number of members that can form a group will be set by the Board from time to time
(e) Upon a current Service Member joining a group the unexpired portion of the Member's fee shall be credited to the Member's subscription.
(f) Upon a Member leaving a group the unexpired portion of their fee shall be credited to ongoing service membership.
2.9 STAFF MEMBERS AND REGIONAL ADVISORY COMMITTEE MEMBERS (amended 28/9/07) :
(a) All employees of the Club (other than Board Members) shall be entitled to be staff members with the benefit of Roadside Ultimate.
(b) A Staff Member shall not be entitled to attend and vote at General Meetings of Members nor to be elected to any office of the Club.
(c) All Members of Regional Advisory Committees of the Club shall be entitled to free Roadside Ultimate membership.
2.10 ACCESS MEMBERS (addition: 28/9/07) :
(a) A class of membership called "Access Membership" shall be created.
(b) Access membership is a free membership that is provided to Insurance and Travel customers who do not hold RACT ROADSIDE and who do not live in a household where an existing Roadside member resides.
(c) Access membership shall entitle the holder to RACT services with the following exceptions:
- An Access Member is not entitled to ROADSIDE service.
- An Access Member is not entitled to stand for the Board or vote at Annual General Meetings.
- An Access Member will not accrue years of membership or be entitled to the Gold Medallion programme.
(d)
(i) Access membership is free and will continue for as long as the Member continues to be a customer of RACT Insurance or RACT Travelworld.
(ii) An Insurance customer is a person who holds a current RACT insurance policy
(iii) A Travel customer is a person who has made a booking for travel with RACT Travelworld within the past 12 months.
3. ACCEPTANCE OF MEMBERS :
(a) Applications for membership shall be in writing or in such other form as the Board shall from time to time determine.
4. ENTRANCE FEES :
(a) All applicants for membership shall pay an initial entrance or application fee as determined by the Board from time to time.
5. MEMBERSHIP FEES :
(a) All membership fees shall be set by the Board from time to time.
(b) Fees are not refundable (except as provided in Discipline By Law 1.6) or transferable to any other person.
DISCIPLINE BY-LAWS :
1. Disciplinary Matters :
1.1 If any member in the opinion of the Board shall infringe any of the Club's Constitution or any of the By-Laws or if the conduct of such member shall in the opinion of the Board be injurious to or prejudicial to the character, welfare or interests of the Club or its members, the Board may call upon such member to justify and explain such conduct either by letter or by personal attendance at a meeting of the Board, especially summoned to consider such conduct.
1.2 If after considering the statement or explanation (if any) made by such member a majority of the members of the Board present at such meeting are of opinion that the conduct of such member has been or is injurious or prejudicial to the character, welfare or interests of the Club or its members, the Board at such meeting may fine, caution, suspend, admonish or (subject to sub clause 1.3 of this By-Law) expel such member, provided that if the offence shall in the opinion of the Board be so flagrant a nature as to justify immediate action the Board may, without calling upon such member to justify and explain, immediately suspend or (subject to sub clause 1.3 of this By-Law) expel such member.
1.3 No Member shall be required to resign or be expelled unless the resolution is passed by three-fourths of the members of the Board present at the special meeting.
1.4 No Member fined, cautioned, admonished, suspended or expelled in pursuance of these provisions shall have any right of appeal.
1.5 Any Member suspended or expelled in pursuance of the foregoing provisions shall forfeit all right to claim upon the Club and the property and funds of the Club.
1.6 In the event of the expulsion a pro rata proportion or any current membership fee paid by the expelled Member shall be refunded and in the case of expulsion of a Life Member the Board shall have power at their discretion as and when the Board may think fit, to repay to such expelled Life Member a proportion of the subscription paid by him in respect of such life membership.
